The first meeting of the office bearers of the UPJSA was held at the conference hall of the District court Lucknow on 04-Dec-2012 from 10 AM to 2PM under the Chairmanship of the President of the association Shree VP Singh the District Judge Sultanpur and was conducted by the General Secretary Shree BN Ranjan.
1. The President of the association Shree VP Singh stressed that all the members should actively participate in each and every meeting and should make an action planning in accordance with the discussions with the officers posted in their districts before arriving for the future meetings.
2. The need was felt to fill up all vacancies of class III and class IV employees. In the present situation more than 25% vacancies are lying vacant in the subordinate courts and the District Judges are deliberately not participating in conducting recruitment of class III and class IV employees due to past experiences. The need has therefore been felt to adopt a centralized recruitment process like the one undertaken in the recruitment of Court managers. Each judicial officer must be provided with 2 stenographers and at the ADJ level at least one steno must be skilled in bilingual typing.
3. Shree R.D. Singh the ex Gen Secretary was appreciated for his generous efforts due to which Rs. 10 crores have been released for the cashless treatment of judicial officers in SGPGI and AIIMS.
4. Resolution was passed for increasing the quota for disposal of contested civil appeals/Civil miscellaneous appeals and 6-ga applications (injunction application) to 1 day. It was stressed that there was no need to revise or reduce the remaining categories of quota system of work done by judicial officers since they have to work even during strikes and have to face adverse entry remarks in case of default.
5. Resolution was passed for immediate disbursement of 3 increments for LLM in accordance with Shetty commission implementation adopted by the Delhi High court.
6. Resolution was passed settlement of arrears of all judicial officers before 31st March 2013.
7. Resolution was passed for Grant of personal pay for family planning and child care, maternity and paternity leaves
8. Resolution was passed for the declaration of official seniority list from Mr. A.K. Jain onwards, separate list of Junior and senior division should be posted on the official website of the Allahabad High Court immediately. The list should not be kept in abeyance.
9. Resolution was passed for creation of 65 Principal Family Judges court having equivalent powers to the court of the District Judge.
10. Resolution was passed for fixing the retirement age of all judicial officers at 62. In this case the I.A has to be pursued in the Apex court and Shree Harish Salve has to be engaged in the matter for which a contribution of Rs. 1000/- has to be paid for contesting the case in favour of the UP Judicial Services Association for immediate relief.
11. Resolution was passed for “Nyayik Pension Scheme” for maintaining the old pension scheme which has to be retained for all judicial officers irrespective of their date of joining and years of service in the HJS which is presently applicable in the Defense Services.
12. Resolution was passed was disbursement of increment and ACP encashment for 2006 batch officers who have completed three years of service immediately.
13. Resolution was passed for promotion of judicial officers of Uttar Pradesh Nyayik Sewa against vacancies which were unfilled in the direct recruitment process for UPHJS in the backlog vacancies of GEN/OBC/SC/ST categories before 31st March 2013 so as to accommodate the promotion of 2003 batch from the vacancies created to resolve the present crisis of pendency of cases.
14. Resolution was passed for clearing the path and making the eligibility of all the judicial officers who are above 35 years of age to qualify for the HJS examination who have a minimum experience of 5 years as a judicial officer or a combined experience of 7 years as an advocate and a judge. The present rider for passing the HJS examination with minimum of 50% marks has to be exempted in the case of OBC/SC &ST categories. In this connection a writ was suggested in the Apex court for amendment of the HJS rules by hiring a reputed advocate. The contribution for this writ @ Rs. 1000/- per interested officer has to be paid for contesting the case in favour of the UP Judicial Services Association for immediate relief. The President of the association Shree VP Singh stressed the need for a meeting with the Hon’ble CM of UP for removal of the rider for both direct and indirect recruitment for HJS examination.
15. Resolution was passed for filing an application in the Allahabad High Court Lucknow for impeding Uttar Pradesh Judicial Services Association (UPJSA) in Case no. 303(SB) 2009 as a party in Avinash Chandra & Ors V/s State of UP in support of the Judicial Officers of 2006 batch and the appointment of a suitable advocate in this case. Shree Vinay Singh, JM Sitapur Executive member present in the meeting was made the nodal head for contesting the case fixed on 7 Dec-2012.
16. Resolution was passed for all judicial officers to attend the felicitation function at the dinner party organised on 09-Dec-2012 in honour of the acting Chief Justice Allahabad High, Hon’ble Mr. Justice Shiv Kirti Singh court from 8-PM onwards at IJTR Lucknow. Judicial Officers were requested to contribute a sum of Rs. 1000/- for this party in favour of the UP Judicial Services Association bank account.
17. Resolution was passed that the UP Judicial Services Association shall furnish a statement of accounts after every six months clarifying each and every transaction and incurring of expenses etc. It was stressed that the aforesaid statement shall be published in the Judges journal.
18. Resolution was passed to authorize Dr Sunil Kumar Singh, Addl Civil Judge Jaunpur for transmitting electronic submission of this press release to the print and electronic media for publication.
19. The distribution of the benevolent funds to the deceased, crippled, seriously ill judicial officers was discussed and was postponed for further study for the amount of Rs.3 to 10 lakhs (refundable) for diseases like kidney, lungs, heart failure and cancer. This matter shall be taken up in a detailed manner in the next meeting . The date of the next meeting shall be finalized at felicitation function at the dinner party organised on 09-Dec-2012 in honour of the acting Chief Justice Allahabad High, Hon’ble Mr. Justice Shiv Kirti Singh court at IJTR from 8-PM onwards
The meeting was attended by the following judges and office bearers of UPJSA Shree Vinay Singh, Saurabh Saxena, Sanjay Chaudhry, Deepak Yadav, Kashi Nath, Udai Veer Singh, Pundeer, Dr. Sunil Kumar Singh etc. It was also decided that the next sports meet shall be organised at Lucknow in the month of February 2013.
