Today CJM , Lucknow Rajesh Upadhyay ordered the Gomti Nagar police to
register a criminal case under appropriate sections against Nirmal Baba, a
Delhi based Godman and investigate it. CJM gave this order on the
application presented by Tanaya Thakur (a student of class 12 and Aditya
Thakur (a student of class 10) under section 156(3) CrPC. Tanaya and Aditya
are children of IPS officer Amitabh and social activist Nutan. Rohit
Tripathi and Neeraj Kumar were counsel of the complainants.  CJM Upadhyay
said that as per the application presented by Tanaya and Aditya, a prima
facie case is found out and there are adequate grounds. He referred to the
Supreme Court judgement in Sri Bhagwan Samardha vs State of AP where a
similar kind of cheating in the name of medical treatment was done by a
Godman.

Tanaya and Aditya had submitted that Nirmal Baba was cheating ordinary and
poor Indians through his improbable solutions which they came under the act
of cheating under sections 417, 419 and 420 IPC and under section 508 IPC
where Godly fear is used. They had gone to Gomtinagar police station on
April 10 to get the FIR registered and when the FIR was not registered even
by the DIG and ADG (Law and Order), they had filed an application before
the CJM, Lucknow on April 17  to get the case registered.

In his report sent on April 24, SO Gomtinagar had said that the
complainants are not directly affected. He had also said that the
complainants were not providing any further evidence and witness, hence the
matter was not getting ahead.
