In the Writ Petition filed by IPS officer from UP

Amitabh Thakur in the Lucknow Bench of Allahabad High Court alleging large-scale harassment against Kunwar Fateh Bahadur, Principal Secretary (Home), Vijay Singh, Secretary to the Chief Minister and others, the High Court has ordered Amitabh Thakur to present a representation before the Chief Secretary of Uttar Pradesh who shall enquire into and decide the matter within 4 months. The bench of Justice D P Singh and Justice S C Chaurasia said that ordinarily such a petition should have been given to the Principal Secretary (Home),  being the head of the Department but since the allegations are against Fateh Bahadur himself, hence the Chief Secretary shall enquire into the matter as the Head of the State administration. The order says that the Chief Secretary shall give hear the grievances of Amitabh and shall also listen to the facts presented by Fateh Bahadur and Vijay Singh before deciding the representation. It said that if any government servant has any kind of grievance, it shall not be left unattended and shall be heard properly. The order also said that the Writ Petition shall be a part of the representation being given to the Chief Secretary. Previously Ashok Pandey, counsel for the petitioner argued that his client is being harassed for not towing to the wrong orders and for working as per law.

In his Writ petition, Amitabh Thakur has cited many instances to show how he is being discriminated against and tortured by these officials because of their personal animosity.

The first example is the way the study leave of Amitabh was refused to him for a very long time and he got his study leave only after eights court cases in CAT, Lucknow and the High Court. He also gives example of how the study leave applications of other IPS officers got processed within 100 days while it took so many years in his case. The second instance is related to his suspension as SP Gonda in which the enquiry was deliberately kept pending for long by Kunwar Fateh Bahadur and got finally cleared when Fateh Bahadur was removed by the Election Commission from the post of Principal Secretary (Home) and Manjeet Singh ordered it to be closed through his ordered on 01 May 2008. In the third case, the Departmental enquiry against Amitabh as SP Deoria got cleared on 25 May 2007 but it was illegally reinitiated on 26 May 2009. This illegal order was finally quashed by CAT, Lucknow in Original Application No 177/2010 through its order dated 08 September 2011. In the fourth case, Amitabh is not being promoted to the rank of DIG because of the influence of these officers despite there being no enquiry pending against him. Similarly, he has been posted to a non-existent Rules and Manuals department which has not yet been created by the State government and the post is not permissible as per IPS (Cadre) Rules. He has also given instances of how Vijay Singh passed many orders on behalf of the Chief Minister in her name whereby he changed the orders of another Chief Minister, something which is completely illegal.

Amitabh presented all these allegations in his various representations to the Chief Minister of Uttar Pradesh on 10 June 2011 and 16 September 2011, the Chief Secretary of Uttar Pradesh  on 04 October 2011, the Principal Secretary (Home) on 15 June 2009, 05 September 2011, 16 September 2011 and 31 October 2011 and the Director General of Police on 25 July 2011 but unfortunately no notice has been taken of these complaints by any of these authorities. Left with no other option, Amitabh had filed this Writ Petition before the High Court.
